In compliance with the Mexican Data Protection Federal Law (Ley Federal de Protección de Datos en Posesión de los Particulares), you are hereby informed that SMT Industries, SA de CV hereinafter SAFE MEDICAL TOURISM respects your right to privacy and is responsible for the use and protection of your personal data.

Regarding your personal data, we inform you of the following:

  1. What personal data will we use?

Personal data SAFE MEDICAL TOURISM may request includes:

  1. Identification and contact information:
  • Names.
  • Surnames.
  • Address.
  • Age.
  • Gender.
  • Nationality.
  • Place of birth.
  • Official identification documents with photography such as: passports, voters ID (INE) or identity documents used in other countries.
  • Home, office and/or cell phone numbers.
  • Email address.
  • Some sensitive data that will be discussed later in this same document.

  • Credit or debit card numbers, exclusively to make collections or payments.
  • RFC Key (Federal Taxpayer Registry)
  • Bank account details, exclusively for payments.
  1. For what purposes will we use your personal data?

The personal data we collect from you will be used for the following purposes:

  1. Necessary purposes for the service requested:
    • Facilitate communication between people interested in obtaining medical, tourism, transportation, gastronomy, and/or accommodation services and the providers of any of these services.
    • Facilitate communication between providers of any activity and/or service demanded by the medical and tourism industry, and the people interested in said services.
    • Being able to recommend the service providers that best suit your needs, requests and travel plans.
    • Being able to recommend the services that as a service provider offer to people interested in hiring them.
    • Make your health status known to service providers.
    • Contact their relatives and/or authorized third parties in case of emergency.
    • Provide with the required referral services.
    • Comply with legal requirements of competent authorities.
    • The identification, operation, administration and commercialization of the contracted services.
    • To be used in any judicial or extrajudicial collection procedure.
    • Comply with fiscal obligations.
    • Preparation and execution of contracts.
  1. Secondary purposes that are not necessary for the requested service but allow us to provide you with a better service:
    1. To send you customer satisfaction surveys.
    2. For marketing or advertising purposes and commercial prospecting.
    3. To inform you about new services, events, changes in our services, and for any advertising or statistical purposes.

Due to the nature of the service during its provision, it is possible that SAFE MEDICAL TOURISM will collect some data considered sensitive, specifically:

  • Past and present illnesses.

Said data will be used solely and exclusively to enable SAFE MEDICAL TOURISM to contact you with service providers that can assist you according to your profile and only under your express consent.

Likewise, SAFE MEDICAL TOURISM guarantees that sensitive data:

  • Will be treated with strict confidentiality.
  • Will only be transferred to third parties that can provide services under warning that it is sensitive data that requires special handling and in strict adherence to the law on the matter.

Likewise, it is reiterated that you may exercise your rights of Access, Rectification, Cancellation or Opposition at any time, through the Transparency Unit of the Department or Entity of your interest, in the terms established in this document.

  1. How will we collect your personal data?

For the activities indicated in this privacy notice, we can collect your personal data in different ways:

  • When you provide it to us directly.
  • When you visit our website or use our online services.
  • Through other sources permitted by law.
  1. Personal Data Transfer:

SAFE MEDICAL TOURISM may transfer some of your personal data and even sensitive data to third parties, such as service providers or related companies. All transfers will be carried out under the appropriate security measures and in accordance with the principles contained in the law of matter.

In accordance with the Federal Law you are informed that third parties who have access to your data will be held under the same obligations that correspond to SAFE MEDICAL TOURISM.

  1. ARCO Rights:

How can you Access, Rectify, Cancel or Oppose the use of your personal data?

You have the right to know what personal data about you we collect, what we use it for and the conditions of use that we give them (Access).

Likewise, it is your right to request the correction of your personal information in case it is outdated, inaccurate, or incomplete (Rectification).

You can request that we remove your personal data from our records or databases when you consider that it is not being used properly (Cancellation).

You can oppose the use of your personal data for specific purposes (Opposition).

These rights are known as ARCO rights.

You may exercise any of your ARCO Rights free of charge and at any time by submitting a request to the person responsible for personal data by sending an email addressed to the Data Protection Department, whose address is: admin@safemedicaltourism.mx , or by presenting an ARCO rights request at our Privacy Office.

Whichever means you choose, your request must indicate:

  • What data does it refer to and the modifications or corrections that you are requesting, or the part of the data that you intend to cancel, or if your intention is to cancel all of them.
  • Name of the personal data owner and address, or other means to send our response to the request.
  • Documents that prove the identity or the legal representation of the personal data owner.
  • A clear and precise description of the personal data on which the personal data owner seeks to exercise any of the aforementioned rights.
  • Any other element or document that facilitates the location of personal data.

SAFE MEDICAL TOURISM will respond to the admissibility of the requests within a maximum period of ten (10) business days by email or by the means of communication indicated by the personal data owner.

  1. Revocation:

When appropriate, you can revoke the consent that you have given us for the processing of your personal data. However, it is important that you take into account that we will not be able to attend to your request or terminate the use immediately in all cases, since it is possible that we need to continue processing your personal data due to some legal obligation.

Likewise, you must consider that for certain purposes, the revocation of your consent will imply that we cannot continue to provide the service you requested, or the conclusion of your relationship with us.

  1. Limitations:

In order for you to limit the use and disclosure of your personal information, we offer you the following means:

  • You may register in the Public Registry to Avoid Advertising, which is in charge of the Federal Consumer Attorney’s Office (PROFECO), so that your personal data is not used to receive advertising or promotions from goods or service companies. For more information, you can consult PROFECO’s Internet portal, or contact them directly.
  • You may also register in SAFE MEDICAL TOURISM’s own exclusion list, so that your personal data is not processed for marketing, advertising or commercial prospecting purposes on our part.

The security and confidentiality of the data that users provide when contracting a service or buying a product online will be protected by a secure server under the Secure Socket Layer (SSL) protocol, in such a way that the data sent will be encrypted to ensure a secure delivery.

However, in spite of constant efforts to have cutting-edge security tools, the protection of data sent over the Internet cannot be 100% guaranteed, so once received, everything possible will be done to safeguard the information.
